1. Acceptance of Terms
By accessing or using BlockshipEx services, you agree to be bound by these Terms and Conditions. If you do not agree to all terms, you may not use our services. These terms apply to all users, including shippers, consignees, and any other parties interacting with our platform.
2. Services
BlockshipEx provides international freight forwarding, logistics coordination, customs brokerage, and shipment tracking services. We act as an intermediary between shippers and carriers and do not take physical possession of goods unless explicitly agreed in writing.
We reserve the right to refuse service to any party at our sole discretion, including shipments that violate applicable laws or regulations.
3. Shipment Responsibilities
The shipper is solely responsible for:
- Accurate declaration of goods, weight, dimensions, and declared value
- Proper packaging suitable for international transit
- Compliance with all export and import regulations of origin and destination countries
- Providing complete and accurate consignee information
- Payment of all applicable duties, taxes, and fees
4. Prohibited Items
The following items are strictly prohibited from shipment through BlockshipEx:
- Illegal substances, narcotics, or controlled materials
- Weapons, firearms, ammunition, or explosives
- Counterfeit goods or items infringing intellectual property rights
- Hazardous materials not properly declared and packaged
- Live animals (unless under a specific written agreement)
- Currency, negotiable instruments, or precious metals above declared thresholds
BlockshipEx reserves the right to inspect, hold, or return any shipment suspected of containing prohibited items, at the shipper's expense.
5. Payment Terms
All charges, duties, and fees are due upon invoice. BlockshipEx may place a hold on shipments pending payment of outstanding balances. Accepted payment methods include cryptocurrency transfers as displayed in the payment portal.
Declared values are used solely for customs and insurance purposes. BlockshipEx is not liable for discrepancies between declared and actual values.
6. Liability Limitations
BlockshipEx's liability for loss, damage, or delay is limited to the lesser of the declared value or the applicable carrier liability under international conventions (e.g., Warsaw Convention for air freight, Hague-Visby Rules for ocean freight).
We are not liable for delays caused by customs authorities, force majeure events, acts of war, natural disasters, or circumstances beyond our reasonable control.
BlockshipEx is not responsible for consequential, indirect, or punitive damages arising from any shipment delay or loss.
7. Insurance
Cargo insurance is available at the rates displayed during shipment creation. Insurance coverage is subject to the terms of the underlying policy. Claims must be submitted within 14 days of the scheduled delivery date.
Shippers who decline insurance accept full risk of loss or damage beyond carrier liability limits.
8. Customs & Compliance
The shipper is responsible for ensuring all shipments comply with applicable customs laws. BlockshipEx may act as customs broker on behalf of the shipper but does not guarantee customs clearance. Any fines, penalties, or storage fees resulting from customs issues are the shipper's responsibility.
9. Tracking & Data
Shipment tracking information is provided for informational purposes only. BlockshipEx does not guarantee real-time accuracy of tracking data. Tracking links are publicly accessible via the unique tracking number — shippers are responsible for sharing this information appropriately.
10. Modifications
BlockshipEx reserves the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.
11. Governing Law
These Terms are governed by and construed in accordance with applicable international commercial law. Any disputes shall be resolved through binding arbitration before resorting to litigation.
